The Steps Taken To Work On Your Case

Step 1: Collection of Evidence


Law Offices of David L Smith will be collecting evidence to use as part of our case against your lender. Evidence our firm will be collecting is document analysis, both manual analysis and computer generated analysis. In addition, our firm will be collecting the client statement. During this stage our firm will also be examining your loans origination and the history of your loan.

Step 2: Attorney Review

After all your loan evidence is compiled your attorney will review your loan. Your attorney will analyze your loan to make a determination for which, if any, laws were broken during the processing of your loan. Lenders must follow the laws and regulations set forth by the Federal and State government and hold true to their duties to you, the borrower. When Lenders fail to follow the laws and regulations and don't fully execute their obligations to you, the borrower, the lender will be found guilty of a violation on your loan.

Step 3: Lawyer Recommendation

When your lawyer has fully reviewed your case, you will be given a statement of the lawyer findings. Your lawyer will also make a recommendation on the next step. Your lawyer will make these suggestions taking in into account your loan violations, your distinctive case and any special circumstances.

Step 4: Demand Letter

Often times, your lawyer will recommend a demand letter. A demand letter is a letter that will be sent to your lender from the Law Offices of David L Smith. This letter will summarize the findings of the lawyer, the evidence against the lender and your demands. The demands will include damages owed to you and the resolution you want. While, the demand letter is extremely important, it is the bases for negotiations with the lender.

Step 4: Legislation

The Law Offices of David L Smith will ensure that you receive the best possible settlement. Your lawyer will take an aggressive approach to fight for you and hold your lender accountable for the violations on your loan. If your lender is unwilling to negotiate, we will take it to the next step and prosecute. This can lead to a number of different paths including: discovery (attorney to attorney), complaint filing, depositions, demure filing, appearances, hearings and possible case settlement. Your attorney will handle all the necessary paperwork and meetings regarding your case. As your case progresses your attorney will keep you informed on the status.
